Theft is classified as a property offence and falls into two categories: Theft Under $5000 and Theft Over $5000. A conviction for Theft Under $5000 carries a sentence of up to two years in prison. Robbery
Robbery is deemed a violent offence, and because of this, the Crown will often seek your detention pending trial if you are facing a robbery allegation, especially if you have a prior record. The Crown may also seek a jail sentence.
Whenever force, or the threat of force occurs in conjunction with taking property or attempting to take property from another person, a charge of Robbery may be laid.
